TERMS OF SERVICE

Pilates Strap LLC

1. ACCEPTANCE OF TERMS

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Pilates Strap LLC, a California limited liability company (“Pilates Strap LLC,” “Company,” “we,” “us,” or “our”).

These Terms govern your access to and use of our website, products, subscription services, digital content, and related offerings (collectively, the “Services”).

By accessing our website, purchasing products, or subscribing to Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree, you may not use our Services.

2. ELIGIBILITY

You must be at least eighteen (18) years old to purchase products or subscribe to membership services.

If a minor uses Pilates Strap equipment or participates in Services, the minor’s parent or legal guardian assumes full responsibility.

3. PRODUCTS & SERVICES

Pilates Strap LLC offers:

  • Pilates Strap Kit

  • Pilates Strap Handles

  • Pilates Strap Double Loops

  • Streaming workout videos

  • Instructional GIFs

  • Live virtual sessions (when offered)

All digital subscription content is streaming-only and licensed for individual use.

4. SUBSCRIPTION MEMBERSHIP

4.1 Membership Access

Pilates Strap LLC offers a subscription-based digital Learning Library providing access to streaming workout videos, instructional content, and related digital materials.

All subscription content is streaming-only and licensed for individual, non-transferable use. Content may not be downloaded, redistributed, or shared.

4.2 Pricing & Free Trial

Membership is billed at $15 per month.

New subscribers receive a seven (7) day free trial. A valid payment method is required at the time of enrollment.

If the subscription is not canceled before the end of the free trial period, the payment method on file will be charged $15, and the subscription will convert to a paid monthly membership.

 

4.3 Automatic Renewal (California Automatic Renewal Law Compliance)

By enrolling in a subscription, you expressly authorize Pilates Strap LLC to charge your payment method automatically.

Subscriptions renew automatically on a monthly basis at $15 per month unless canceled prior to the renewal date.

Charges will recur each month until canceled.

You will receive confirmation of your subscription and renewal terms upon enrollment.

4.4 Cancellation

You may cancel your subscription at any time through your account dashboard.

Cancellation must occur before the renewal date to avoid the next billing charge.

Cancellation stops future charges only and does not result in a refund of prior payments.

If canceled during the free trial period, no charge will be applied.

Access to subscription content continues until the end of the current billing period.

4.5 No Refunds for Subscription Services

All subscription payments are final and non-refundable.

Failure to use the subscription does not constitute grounds for a refund.

 

5. INTELLECTUAL PROPERTY & PERMITTED USE

All digital content, videos, instructional materials, graphics, branding, logos, designs, and written materials are the exclusive property of Pilates Strap LLC and are protected by intellectual property laws.

Equipment Use

Pilates Strap equipment may be used for personal or professional instruction.

You may:

  • Use equipment in private or group training sessions.

  • Incorporate equipment into client instruction.

  • Use equipment in studio, in-home, or online settings.

Digital Content Restrictions

Digital subscription content is licensed to the individual account holder only.

You may not:

  • Download, reproduce, distribute, or rebroadcast digital content.

  • Share login credentials.

  • Stream subscription content to third parties.

  • Copy, resell, sublicense, or create derivative works.

Use of Pilates Strap trademarks for commercial promotion requires written permission.

6. SHIPPING & DELIVERY

Pilates Strap LLC ships within the United States only.

Orders are considered delivered when marked delivered by the carrier to the shipping address provided at checkout.

Pilates Strap LLC is not responsible for:

  • Lost or stolen packages confirmed delivered.

  • Delivery delays caused by carriers.

  • Errors in shipping addresses provided by the customer.

7. PAYMENT DISPUTES & CHARGEBACKS

You agree not to initiate a chargeback or payment dispute without first contacting Pilates Strap LLC to attempt resolution.

Pilates Strap LLC reserves the right to provide proof of delivery and digital access records to payment processors in the event of a dispute.

8. DISCLAIMER OF WARRANTIES

All products and Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied.

To the fullest extent permitted by law, Pilates Strap LLC disclaims all warranties, including but not limited to:

  • Implied warranties of merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Accuracy or reliability of content

Pilates Strap LLC does not guarantee uninterrupted or error-free access to digital Services.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by California law, Pilates Strap LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to use of the Services or products.

Total liability shall not exceed the amount paid by you to Pilates Strap LLC in the twelve (12) months preceding the claim.

Nothing in this section limits liability for gross negligence or willful misconduct where prohibited by law.

10. FORCE MAJEURE

Pilates Strap LLC shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including but not limited to:

  • Natural disasters

  • Supply chain disruptions

  • Carrier delays

  • Government actions

  • Platform outages

  • Acts of God

11. ARBITRATION & CLASS ACTION WAIVER

Any dispute arising out of or relating to these Terms or use of the Services shall be resolved exclusively through binding arbitration in San Diego County, California.

You waive:

  • The right to trial by jury

  • The right to participate in a class action lawsuit

Arbitration shall occur on an individual basis only.

12. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.

13. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. CHANGES TO TERMS

Pilates Strap LLC reserves the right to update or modify these Terms at any time.

Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
