Medical Disclaimer and Liability Waiver

Pilates Strap LLC

1. Assumption of Risk

I understand that participation in physical exercise and the use of resistance-based equipment, including the Pilates Strap Kit, Handles, Double Loops, springs, and accessories (“Equipment”), involves inherent and significant risks.

These risks include, but are not limited to:

• Muscle strains, tears, or sprains
  
  
• Joint, ligament, or tendon injuries
  
  
• Back or neck injury
  
  
• Cardiovascular complications
  
  
• Falls
  
  
• Pinch injuries from springs or tension components
  
  
• Serious bodily injury
  
  
• Illness
  
  
• Permanent disability
  
  
• Death
  
  

I knowingly and voluntarily assume all risks, known and unknown, associated with the use of the Equipment and participation in Pilates Strap LLC services.

2. Unsupervised Participation & Personal Responsibility

I understand that Pilates Strap Learning Library content, including videos, GIFs, and live virtual sessions, is educational and informational in nature.

Pilates Strap LLC does not:

• Monitor my participation
  
  
• Evaluate my form or technique
  
  
• Supervise my environment
  
  
• Assess my medical condition
  
  
• Provide individualized instruction
  
  

I agree that:

• I participate at my own risk.
  
  
• I am solely responsible for determining my physical readiness.
  
  
• I will exercise within my personal limits.
  
  
• I will stop immediately if I experience pain, dizziness, or discomfort.
  
  
• I am responsible for maintaining a safe exercise environment.
  
  

3. Equipment Safety & Proper Use

I agree to inspect all Equipment prior to each use and will not use any Equipment showing signs of wear, damage, stretching, or compromised springs.

I will not modify or alter the Equipment.

I understand that resistance springs create stored tension and potential pinch points.

I agree to:

• Keep loose clothing, jewelry, and accessories away from springs
  
  
• Secure long hair
  
  
• Keep fingers and hands clear during attachment and detachment
  
  
• Ensure proper setup before applying resistance
  
  

Failure to follow these precautions increases risk of injury.

4. Professional & Commercial Use

Pilates Strap equipment may be used for personal or professional instruction.

If I use the Equipment in a professional capacity, I acknowledge and agree that:

• I am solely responsible for supervising my own clients.
  
  
• I am solely responsible for assessing client readiness and safety.
  
  
• Pilates Strap LLC does not supervise, control, or direct professional instruction.
  
  
• Pilates Strap LLC is not responsible for claims arising from my instruction of others.
  
  
• I am responsible for maintaining any licenses, certifications, or insurance required by applicable law.
  
  

Digital subscription content may not be redistributed, rebroadcast, recorded, or publicly displayed without written permission.

5. Medical Disclaimer

Pilates Strap LLC does not provide medical advice.

I understand that I should consult a licensed healthcare professional before beginning any exercise program.

I represent that I have no medical condition that would make participation unsafe without physician approval.

6. Release and Waiver of Liability

To the fullest extent permitted by California law, I release, waive, and discharge Pilates Strap LLC, its owners, officers, employees, contractors, affiliates, and agents from any and all claims, liabilities, demands, damages, or causes of action arising out of or related to:

• Use of the Equipment
  
  
• Participation in digital content
  
  
• Participation in live sessions
  
  
• Reliance on instructional materials
  
  
• Professional use of the Equipment
  
  

This release includes claims arising from ordinary negligence to the fullest extent permitted by law.

This release does not apply to gross negligence or willful misconduct.

7. Indemnification

I agree to indemnify and hold harmless Pilates Strap LLC from any claims, damages, or liabilities arising out of:

• My use of the Equipment
  
  
• My participation in services
  
  
• My professional instruction of others
  
  

8. Age Representation

I represent that I am at least eighteen (18) years old.

If a minor participates, I represent that I am the minor’s parent or legal guardian and assume full responsibility for the minor’s participation.

9. Binding Arbitration & Dispute Resolution

Any dispute arising out of or relating to this Waiver or use of the Equipment shall be resolved exclusively by binding arbitration in San Diego County, California.

Arbitration shall be conducted pursuant to the Federal Arbitration Act.

The parties waive the right to a jury trial and agree that disputes will be resolved on an individual basis and not as part of any class or representative action.

 

10. Governing Terms

This policy is incorporated into and subject to the Pilates Strap LLC Terms of Service. In the event of any conflict between this policy and the Terms of Service, the Terms of Service shall control.
